This Acceptable Use Policy (“AUP”) governs the use of all services provided by Hostoy (“Hostoy”, “we”, “us”, or “our”), including web hosting, VPS, dedicated servers, domain services, email services, and related products.
By using Hostoy services, you (“Customer”, “User”) agree to comply with this AUP, our Terms of Service, Privacy Policy, and all applicable local, national, and international laws.
The purpose of this policy is to protect Hostoy, its customers, its network, and the broader internet ecosystem.
1. Customer Responsibilities
You are fully responsible for:
- All content hosted, transmitted, or stored under your account
- All activity performed using your services, whether authorized or not
- Ensuring your use of the services complies with this AUP and applicable laws
- Maintaining the security of your account credentials and hosted applications
Hostoy does not assume responsibility for customer content or activities.
2. Prohibited Illegal Activities
You may not use Hostoy services to engage in, support, or facilitate illegal activities, including but not limited to:
- Distribution of copyrighted material without proper authorization
- Circumvention of copyright protection or DRM systems
- Fraud, scams, impersonation, phishing, or financial deception
- Identity theft or unauthorized data collection
- Sale, promotion, or distribution of illegal goods or services
- Hosting or transmitting child sexual abuse or exploitation material
Any involvement in child exploitation will result in immediate termination without notice and reporting to appropriate law enforcement authorities.
3. Security & Network Violations
You may not use Hostoy services to compromise, probe, or disrupt any system, network, or service. Prohibited activities include, but are not limited to:
- Hacking, cracking, or unauthorized access attempts
- Port scanning, vulnerability scanning, or brute-force attacks
- Distributed Denial-of-Service (DDoS) attacks
- Malware, viruses, trojans, spyware, ransomware, or botnets
- Hosting exploit kits or tools designed for malicious activity
- Bypassing security, authentication, or access controls
Hostoy may immediately suspend services that pose a security risk.
4. Email, Spam & Messaging Abuse
Hostoy enforces a strict zero-tolerance policy for spam and email abuse. You may not:
- Send unsolicited bulk or commercial email (spam)
- Use purchased, rented, or scraped mailing lists
- Operate open mail relays, proxies, or misconfigured mail servers
- Engage in phishing, spoofing, or deceptive messaging
- Cause IP addresses or domains to be listed on spam blacklists (RBLs)
Email abuse may result in immediate suspension to protect network reputation.
5. Resource Usage & Fair Use Policy
All services are subject to fair and reasonable usage. You may not:
- Consume excessive CPU, RAM, disk I/O, or bandwidth
- Run persistent background processes on shared hosting
- Host applications that negatively impact other users
- Operate crypto-mining software unless explicitly approved
- Use hosting services primarily for file storage or backups
Hostoy reserves the right to:
- Throttle or limit resources
- Require service upgrades
- Suspend accounts affecting system stability
6. Content Restrictions
You may not host, store, or distribute content that is:
- Illegal under applicable law
- Harmful, abusive, or exploitative
- Designed to deceive, defraud, or harm others
The following content or activities are restricted and require prior written approval from Hostoy:
- Adult or sexually explicit content
- Streaming or media broadcasting platforms
- File-sharing, mirror, or download services
- APK files or software distributions
- Large media libraries (MP3, video, ISO files)
- Public backup repositories
Hostoy reserves the right to remove content that violates this policy.
7. Intellectual Property Rights
You must respect intellectual property laws and rights. You may not:
- Host pirated software, movies, music, or books
- Distribute cracked software or license keys
- Enable or promote copyright infringement
Valid copyright or trademark complaints may result in content removal or service suspension.
8. Website & Application Security
You are responsible for maintaining the security of your website, applications, and account, including but not limited to:
- Using licensed and legitimate themes, plugins, and software
- Keeping all software up to date
- Avoiding nulled, cracked, or pirated content
- Using strong passwords and secure authentication methods
Hostoy is not liable for data loss, downtime, or security incidents caused by:
- Nulled or cracked themes/plugins
- Outdated software
- Weak passwords or compromised credentials
8.1 Use of Nulled, Cracked, or Outdated Software
To maintain a secure hosting environment, customers must not use insecure, pirated, or outdated software.
Nulled or Cracked Themes & Plugins
- Use of Nulled, Cracked, or pirated themes and Plugins is not permitted
- Such software commonly contains malware, backdoors, or hidden malicious code
- These pose serious security risks to your website, our servers, and other customers
Hostoy will not provide support for websites using nulled or cracked software. If your account is compromised due to the use of such software, Hostoy will not be held responsible.
Outdated Themes, Plugins, or Scripts
- Customers are responsible for keeping all themes, plugins, CMS platforms, and scripts up to date
- Outdated software is a major cause of hacking and malware infections
Accounts compromised due to outdated software may be suspended until secured.
Weak Usernames & Passwords
- Customers must use strong, unique usernames and passwords
- Weak or default credentials significantly increase the risk of unauthorized access
Hostoy is not responsible for security breaches resulting from weak passwords or poor security practices.
Security-Related Suspensions
Hostoy reserves the right to:
- Suspend affected services to prevent further damage
- Require customers to remove insecure software before reactivation
- Take immediate action if malware threatens server stability
9. Malware Scanning & Threat Detection
Hostoy may implement automated security tools, including malware scanners and intrusion detection systems, to help protect our servers and customers.
- Malware scanning may be performed on hosted accounts to identify security threats.
- These scans are intended to protect server stability and network integrity.
- Hostoy does not guarantee the detection or removal of all malware.
If malicious activity or infected files are detected, Hostoy may:
- Temporarily suspend the affected service
- Isolate compromised files or accounts
- Notify the customer to take corrective action
Customers remain fully responsible for securing their websites and removing malware.
10. Abuse Reports & Cooperation
Hostoy investigates all abuse complaints, including:
- Spam reports
- Malware or hacking activity
- Copyright infringement notices
- Network or resource abuse
You must respond to abuse notifications promptly and cooperate fully. Failure to do so may result in suspension or termination.
11. No Obligation to Monitor Content
Hostoy does not actively monitor customer content. However, we reserve the right to investigate suspected violations and take appropriate action.
12. Enforcement & Corrective Actions
Hostoy may, at its sole discretion:
- Issue warnings or notices
- Temporarily suspend services
- Permanently terminate accounts
- Remove or disable content
- Report illegal activity to authorities
Serious violations may result in immediate termination without prior notice.
13. Emergency & Force Protection
Hostoy may suspend services immediately if necessary to:
- Protect the network or infrastructure
- Prevent ongoing abuse or attacks
- Comply with legal or regulatory obligations
14. Changes to This Policy
Hostoy reserves the right to modify this Acceptable Use Policy at any time. Changes will be posted on our website, and continued use of our services constitutes acceptance.
